1. Agreement to Terms

By accessing or using the website chairfilledmedia.com (the “Site”) operated by ChairFilled Media (“we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Site or services.

2. Services

ChairFilled Media provides digital marketing services exclusively for dental practices, including but not limited to paid advertising management (Google Ads, Meta Ads), landing page creation, review generation systems, website design, marketing automation, and CRM setup. Specific services, deliverables, and pricing are outlined in individual service agreements between ChairFilled Media and each client.

3. Service Agreements

All marketing services are governed by a separate Service Agreement that outlines scope, pricing, payment terms, and responsibilities. These Terms of Service apply to your use of the website; the Service Agreement governs the delivery of marketing services.

4. Payment Terms

Payment terms are specified in individual Service Agreements. Generally, management fees are due monthly in advance. Ad spend is paid directly by the client to the advertising platform (Google, Meta, etc.) and is separate from our management fees.

5. Cancellation

Either party may terminate services with 30 days written notice. No cancellation fees or penalties apply. Upon cancellation, the client retains ownership of all ad accounts, campaign data, landing pages, and creative assets.

6. Performance Guarantee

Our performance guarantee of 20 qualified patient inquiries within the first 60 days is subject to the following conditions: the client must maintain the agreed-upon minimum ad spend, the client must provide timely access to necessary accounts and assets, and the client must not make unauthorized changes to campaigns or landing pages during the guarantee period. A “qualified inquiry” is defined as a form submission, phone call, or booked appointment from a person genuinely interested in the client’s advertised services.

7. Intellectual Property

The client retains ownership of their brand, logo, practice content, and patient data at all times. ChairFilled Media retains ownership of proprietary processes, templates, and methodologies used to deliver services. Ad accounts, campaign data, and landing pages created for the client are owned by the client.

8. Limitation of Liability

ChairFilled Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or data, arising from your use of our Site or services. Our total liability shall not exceed the amount paid by you to ChairFilled Media in the 3 months preceding the event giving rise to the claim.

9. Disclaimer of Results

While we strive to deliver measurable results for every client, we cannot guarantee specific outcomes. Marketing results depend on numerous factors including market conditions, competition, ad spend levels, and the client’s ability to convert leads into patients. Past results and case studies presented on our Site do not guarantee future performance.

10. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of the business relationship. This includes campaign strategies, performance data, pricing, and client lists.

11. Website Use

You agree not to: use our Site for any unlawful purpose, attempt to gain unauthorized access to our systems, interfere with the proper functioning of our Site, copy, distribute, or modify any part of our Site without our written consent, or use automated tools to access or scrape our Site.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised terms.
